Get a lawyer, file first, protect your custody rights, get all financial records so your accounts don't get drained, ask your lawyer how to boot him out of the house.
 
@Wiseowl : Excellent advice. Get a lawyer immediately. It seems to be important that he be the one to move out.

I grew up in an "old" household. You do what is expected, as a Mom/wife.
 
My father just asked me why I don't stand up for myself.

@ctl74 : It is a joint state. You need to know all the accounts and the account numbers. Go through all your financial records you don't want him hiding anything from you. You'll get joint custody of the kids. That's how Texas works. You'll split your financial down the middle half-and-half. You'll get part of his retirement half-and-half. Then you'll sell your home and he'll get half you'll get half. If the kids live with you you'll get child support even if it's joint custody. If he gets custody and ask for support you may have to pay him

@ctl74 : There's a lot of misinformation swirling around in this thread. I suggest you start here-https://texaslawhelp.org/guide/i-need-a-divorce-we-have-children-under-18. I do not know your financial situation but many attorneys will do a 30 min free consultation. You can also contact legal aid clinics, such as Lone Star. You can't just kick him out and he can't just kick you out. Who lives in the home during a divorce is usually determined during a temporary orders hearing. Also, yes, Texas is a community property state but that is a presumption that can be rebutted by various factors, such as fault in the break up of the marriage. You can certainly request a different division of property other than 50/50. Doesn't mean you will get it as this is what trials are for. Contested divorces are time consuming and expensive. If you guys can work it out amicably through an agreement, I'd highly suggest it. Good luck.

@ctl74 : I have a friend was told, by her family, she did not need to go to collage, that she was just going to get married and have kids. It would be a waste of money. On the other hand, she is expected to be able to make loads of money, all without and education. Her parents have unreal expectations.
 
When hubby and I got married we decided I would quit working to have and raise the kids. I have been out of the workforce for 30+ years. I would not want to do what I have been educated for if I had to go back to work. My advice to you is go ahead and get started on getting an education in the field you decide you want to work in. Take it slow and you will be finished in no time. Start at the community college level and take advantage of all the help they have to offer to finance your education. Women get a lots of financial aid.

@ctl74 : No offense intended but it sounds like you're being taken advantage of. I say that because I have felt that way quite often in my life too. It is not a good feeling. I admire that you don't want to just quit and you want to work things out.. but you have to realize it may or it may not work out. It sounds like he does not want it to. Maybe he has some redeeming qualities we do not know about, but right now he does not sound very nice.
